These Terms govern access to and use of the Toytown website, products, and services. “We,” “us,” and “our” refer to Toytown. “You” refers to a website visitor or customer.

By using our website or placing an order, you agree to these Terms and our other published policies.

2. Eligibility

You must be at least the age of majority in your province or territory to place an order.

Children may use our products only with appropriate adult supervision and according to applicable age recommendations, instructions, and safety warnings.

You agree to provide accurate billing, shipping, payment, and contact information.

3. Products and Toy Safety

We make reasonable efforts to display accurate product descriptions, images, prices, colours, dimensions, materials, package contents, age recommendations, warnings, and availability.

Minor differences may arise from lighting, screen settings, packaging updates, or manufacturing changes.

Parents and caregivers are responsible for reviewing age recommendations, following safety instructions, providing appropriate supervision, and inspecting toys regularly.

Toytown does not claim that Health Canada has certified or approved a product unless that statement is accurate and documented.

4. Prices and Currency

Unless otherwise stated, prices are displayed in Canadian dollars (CAD).

Applicable taxes, shipping charges, discounts, and the final total are displayed before payment.

Prices and promotions may change. Changes will not affect an accepted order except where an obvious error requires correction and applicable law permits it.

5. Orders

Submitting an order is an offer to purchase from Toytown. An automated confirmation acknowledges receipt but does not necessarily constitute order acceptance.

We may refuse or cancel an order because of:

Product unavailability
Incorrect price or product information
Suspected fraud or unauthorized payment
An incomplete or invalid address
Quantity restrictions
A product-safety concern or recall
Violation of these Terms

A cancelled paid order will be refunded to the original payment method.

6. Payments

Payments are processed by third-party payment providers. We do not intentionally store complete payment-card numbers on our systems.

You authorize Toytown and its payment providers to charge the total displayed at checkout.

7. Shipping

Orders are normally processed within 1–2 business days. Estimated delivery within Canada is 3–5 business days after shipment.

Delivery estimates may be affected by severe weather, holidays, remote locations, incorrect addresses, carrier disruptions, or other circumstances outside our reasonable control.

8. Returns and Refunds

Customers may request a return for any reason within 30 calendar days after delivery.

Customers pay return shipping for ordinary change-of-mind returns. Toytown pays reasonable return costs for damaged, defective, incorrect, incomplete, unsafe, or materially misdescribed products.

9. Damaged or Unsafe Products

Stop using any item that appears defective or unsafe and contact us promptly.

Available remedies may include a replacement, refund, prepaid return label, missing component, or appropriate safety instructions.

Safety and recall remedies are not restricted by the ordinary 30-day return period.

10. Intellectual Property

Original Toytown website content—including our name, logo, design, graphics, text, and photographs—is owned by or licensed to Toytown.

Third-party trademarks belong to their respective owners. Their appearance does not imply a partnership or endorsement unless expressly stated.

You may not copy, scrape, modify, distribute, or commercially exploit our content without permission.

11. Prohibited Uses

You may not use our website:

For illegal, fraudulent, or deceptive activity
To violate intellectual-property or privacy rights
To transmit malicious code
To compromise website security
To submit false reviews or information
To place fraudulent orders or abuse promotions

12. Third-Party Services

Our website may use third-party payment, shipping, analytics, security, or technology services. These providers may maintain separate terms and privacy policies.

13. Consumer Rights

Nothing in these Terms excludes warranties, remedies, safety obligations, or consumer rights that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by law, Toytown is not liable for indirect, incidental, special, or consequential losses.

This limitation does not apply where liability cannot legally be limited.

15. Changes to These Terms

We may update these Terms for legal, regulatory, or operational reasons. The current version will be posted with its effective date.

16. Governing Law

These Terms are governed by Ontario law and applicable federal Canadian law, without limiting mandatory protections available elsewhere in Canada.
